前些日子台风过境后,徐汇区天平街道一家咖啡店屋顶渗漏,咖啡机泡了水,只能暂时关门。后续沟通中,店方与物业就责任认定和赔偿僵持不下。下沉到街道的法官和调解员很快介入,一边督促物业完成检修,一边围绕“台风算不算不可抗力”“损失怎么核算”逐项释法说理,最终促成双方达成调解协议,咖啡店很快重新开门营业。
咖啡店越开越多,空间冲突、环境压力、邻里矛盾、风貌约束和流量管理这些“成长的烦恼”就越藏不住。天平街道2.68 平方公里的街区,聚集了152家咖啡店,从业人员600余名,密度高达每平方公里57家,其中精品独立咖啡馆占比约七成。
日前,《天平街道咖啡行业软法指引》(简称“指引”)在徐汇发布,这是全市首份咖啡行业的专项软法指引,为想开店、在开店的咖啡经营者递上一本量身定制的“经营避坑指南”。
“这份《指引》是通过梳理大量纠纷案例,并走访商户调研形成的。传统刚性的执法手段难以适应咖啡行业柔性化、个性化的经营特点,所以我们想探索一种软法治理路径。”徐汇区司法局副局长聂元军介绍,《指引》以现行法律法规为依据,聚焦市容门责管理、用工权益保障、邻里关系协调三大高频痛点,梳理了租赁、装修备案、用工、食品安全等环节法律风险,并同步公示了配套服务资源。
《指引》中不仅把开店的全过程讲得很细,还点出了每个环节容易忽略的问题。比如申请食品经营许可证,咖啡店经营必选“自制饮品制售”,如果还有简餐或者烘焙,就要增加“热食类食品制售”,要是漏填了,还得跑一趟变更。另外,如果纯卖咖啡、茶饮,一般不用办城镇污水排入排水管网许可,可一旦含餐食制作,会产生油烟和含油废水,就必须办理。
“用工更是纠纷的多发环节,咖啡店用工形式多样,不同用工关系对应不同的合同类型和法律义务,我们都在《指引》里逐个讲清楚了。”天平街道司法所副所长彭炜玉说,店长、全职咖啡师、烘焙师等全日制劳动关系,必须要签劳动合同;小时工是非全日制用工,日均工作不得超过4小时、每周累计不超过24小时,超时可能会被认定为全日制用工。
《指引》还贴合“梧桐区”的经营特色,想到了更多细节,比如:宠物友好店铺怎么规范、临街经营怎么守秩序、风貌区开店怎么保颜值、怎么平衡客流生意和居民安宁等。
同时,对一些容易被忽略的知识产权风险作出提示:店名、Logo在开业前就注册好商标,被他人抢注后就要被迫更名;门店播放音乐要拿到中国音乐著作权协会和中国音像著作权集体管理协会的授权,不然可能面临每首歌数千甚至数万元的索赔。
“除了发布《指引》,把可能踩的‘坑’提前标出来,街道日常还依托综治中心、党群服务中心,每周免费开展法律咨询、公证咨询活动,持续为商户提供调解、法律服务等常态化支持。”彭炜玉说,希望通过这些举措,用法治的尺度规范经营行为,用法治的温度化解邻里纠纷,让咖啡店主安心经营,也让衡复风貌区的咖啡香飘得更远。

The more coffee shops open, the more "growing pains" such as spatial conflicts, environmental pressure, neighborhood conflicts, style constraints, and traffic management become difficult to hide. The 2.68 square kilometer block of Tianping Street is home to 152 coffee shops with over 600 employees, with a density of 57 shops per square kilometer. Among them, boutique independent coffee shops account for about 70%.

Recently, the "Soft Law Guidelines for the Coffee Industry in Tianping Street" (referred to as the "Guidelines") were released in Xuhui. This is the first special soft law guideline for the coffee industry in the city, providing a tailor-made "Operation Avoiding Pits Guide" for coffee operators who want to open or are currently opening stores.

This' Guideline 'was formed by sorting out a large number of dispute cases and visiting merchants for research. Traditional rigid law enforcement methods are difficult to adapt to the flexible and personalized business characteristics of the coffee industry, so we want to explore a soft law governance path.' Nie Yuanjun, Deputy Director of the Xuhui District Judicial Bureau, introduced that the 'Guideline' is based on current laws and regulations, focusing on the three high-frequency pain points of urban appearance management, employment rights protection, and neighborhood relationship coordination, sorting out legal risks in leasing, decoration filing, employment, food safety and other links, and synchronously publicizing supporting service resources.

The "Guidelines" not only provide detailed explanations of the entire process of opening a store, but also point out issues that are easily overlooked in each step. For example, when applying for a food business license, coffee shops must select "homemade beverage production and sales". If there are also light meals or baked goods, "hot food production and sales" must be added. If it is missed, a change must be made. In addition, if selling only coffee and tea drinks, there is generally no need to obtain a permit for discharging urban sewage into the drainage network. However, once the food is prepared, it will produce oil fumes and oily wastewater, which must be processed.

Employment is a frequent point of dispute, and coffee shops have diverse forms of employment. Different employment relationships correspond to different types of contracts and legal obligations, which we have explained in the "Guidelines" one by one. Peng Weiyu, deputy director of the Tianping Street Judicial Office, said that full-time employment relationships such as store managers, full-time baristas, and roasters must sign labor contracts; Hourly workers are part-time employees, with a daily work limit of no more than 4 hours and a cumulative weekly work limit of no more than 24 hours. Overtime may be recognized as full-time employment.

The Guide also fits in with the business characteristics of "wutong District" and thinks about more details, such as how to standardize pet friendly stores, how to keep order in street operations, how to maintain the appearance of stores in the style and appearance area, and how to balance passenger flow, business and residents' peace.

At the same time, a warning should be given to some easily overlooked intellectual property risks: store names and logos should be registered as trademarks before opening, and if they are preemptively registered by others, they will be forced to change their names; Store music playback requires authorization from the China Music Copyright Association and the China Audio Visual Copyright Collective Management Association, otherwise it may face claims of thousands or even tens of thousands of yuan per song.

In addition to issuing the "Guidelines" and marking potential "pitfalls" in advance, the street also relies on the Comprehensive Governance Center and the Party and Mass Service Center to provide free legal consultation and notarization consultation activities every week, and continues to provide normalized support such as mediation and legal services for merchants. Peng Weiyu said that through these measures, he hopes to standardize business behavior with the scale of the rule of law, resolve neighborhood disputes with the warmth of the rule of law, let coffee shop owners operate with peace of mind, and also let the coffee aroma of Hengfu style area drift further.
